1. About these terms
These terms apply when you use MyNikkahMate, including the iPhone and Android apps and the web app (together, “the app”). The app is provided by Purple Loop Limited, registered in England and Wales, company number 08069332, registered office 195 High Street, Lye, Stourbridge, DY9 8LH (“we”, “us”).
By creating an account or using the app, you agree to these terms. If you don’t agree, please don’t use the app. Our privacy policy explains how we handle personal data, including how we act as your processor for the people on your entries.
2. Your account
- You must be at least 18 years old to create an account. An account is meant for an institution (a mosque, an Islamic centre, an independent imam) and is its register; it has one login in this release.
- Please give us an email address you can access, and keep your sign-in details to yourself. You are responsible for what happens under your account and for everything recorded in your register.
- If you think someone else has got into your account, change your password and let us know straight away.
3. A record-keeping aid, not a registration
MyNikkahMate is designed to help you record and keep things. It is not a substitute for:
- a civil marriage, its registration with the civil authorities or a civil marriage certificate. An entry in MyNikkahMate and a nikkah nama printed from it are your institution’s own record and certificate of the religious ceremony; they have whatever standing your institution and the people concerned give them, and none in civil law;
- the checks your institution makes before a nikkah: the identity, age, consent, marital status and capacity of the parties, the presence of witnesses and anything else your institution’s practice or the law requires. The “Before the nikkah” checklist and the app’s refusal to register an entry for a person under 18 are aids to your own checks, not a substitute for them;
- advice from a scholar, a solicitor or another professional.
The ready-made checklist is a general starting point and may not suit your institution. Check it against your own practice and adjust it. Reminders and statuses depend on the information you enter and on your device working as expected, so they may be late, missing or wrong. Always use your own judgement.
4. Your register, your responsibility
You are responsible for conducting the nikkah lawfully and for complying with the law that applies to you, including the law on marriage and on the age of marriage in England and Wales, Scotland or Northern Ireland as it applies to you, and for the accuracy of everything you record. You are also responsible for the people you record on your entries and as officiants: for having a lawful basis to record their details, ID photos and signatures, for telling them what you record and why, for recording only what you need, and for answering their requests about it (our privacy policy, section 10). Please take a photo only of the identity document a person shows you for the nikkah, and never of anything else.
5. The register: registered entries are frozen
When you register an entry it takes the next number in your register and is frozen: its details, the people on it, their signatures and their ID photos can no longer be edited or deleted, in the app or on our servers. This is by design, so that your register can be relied on as a record. A mistake is corrected by voiding the entry (with a reason) and recording a new one; notes, extra photos, documents and checks can still be added to a registered entry. Drafts can be edited and deleted freely until they are registered. By registering an entry you confirm that the people on it signed it themselves on the device and saw its details before signing.
6. Your content
The records you enter belong to you (or to the people they are about, as the law provides). You give us permission to store, process and sync them, to build the nikkah nama from them and to email the copies you ask for, only so that we can provide the app to you. We won’t use them for anything else except as described in our privacy policy.
Photos, signatures and files you add are stored with your account so they are available on all your devices. We take care to keep them safe, but please keep your own copies of anything important: the app’s export gives you the whole register at any time.
7. Using the app fairly
Please don’t:
- break the law using the app, record a nikkah that the law does not allow, or store content you don’t have the right to store;
- try to access other institutions’ accounts or registers, or get around any security measures;
- overload, disrupt, copy or reverse-engineer the app or our servers, except where the law allows it;
- use automated tools to access the service other than the app itself.
Up to 2,000 nikkahs per register. MyNikkahMate is made for a single institution’s register, and each account can hold up to 2,000 nikkahs (officiants and documents are not counted). If your institution records more than that, or you want to import an older register, please email [email protected] first. We may be able to offer a separate plan for that. Each account also includes 5 GB of storage for photos, signatures and files, with up to 12 photos or files on each nikkah, each person on it, each document and your institution; if you need more, get in touch.
8. Price, trial, availability and changes
Price, trial and subscription. Every new account starts with a 30-day free trial. No card is taken for the trial, and we email you a reminder 7 days before it ends and on the last day. After that, MyNikkahMate is an auto-renewing yearly subscription at £9.99 (prices include VAT where it applies). You buy it in the iPhone or Android app, and it is billed through the App Store or Google Play under their terms. You can manage or cancel it in your App Store or Google Play settings. Cancel at least 24 hours before it renews to avoid the next charge. Refunds are handled by Apple or Google under their policies. Without an active subscription your account is read-only: you can still see, print and export your register, and we keep your register for as long as your account exists (see our privacy policy); nothing is deleted because a subscription has ended. We will give you notice before any price change.
We work hard to keep it running smoothly, but we can’t promise it will always be available or error-free. The phone apps keep working offline and sync your changes once they can reach our servers again; the printed nikkah nama and the emailed copies need a connection.
We may improve, change or remove features over time. If we introduce any other paid features, we will explain them clearly beforehand, and you won’t be charged for anything you haven’t chosen. If we ever decide to close the service, we will give you reasonable notice and time to export your register.
9. Ending your account
You can stop using the app and delete your account at any time. See how to delete your account. Deletion is permanent and deletes the whole register, which is why the app offers an export first and asks you to type your institution’s name.
We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to for legal reasons. Where it’s reasonable, we will tell you first, explain why and give you time to export your register.
10. Our responsibility to you
We provide the app with reasonable care and skill. Beyond that, and as far as the law allows, we are not responsible for any loss or damage caused by relying on the app (for example an entry recorded with wrong details, a nikkah conducted when it should not have been, a document that lapsed, a certificate copy that did not arrive, or any dispute between the people on an entry) or for losses that were not reasonably foreseeable.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be limited. Nothing in these terms affects your legal rights as a consumer.
11. Changes to these terms
We may update these terms from time to time. We will change the “last updated” date above, and if the changes are significant we will let you know in the app or by email before they take effect. If you keep using the app afterwards, the new terms will apply.
12. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
